Terms of Use

Pixaface provides an AI-powered image transformation service that allows users to:

• LinkedIn Professional Mode: Create professional headshots with customizable backgrounds and attire
• Funhouse Creative Mode: Transform photos with artistic styles including anime, oil paintings, sketches, and more
• Image History: Access and manage previously generated images

Account Creation

• You may use Pixaface without an account with limited access (2 generations)
• Creating an account provides increased daily limits (5 generations per day)
• You can sign in using third-party authentication providers (Google, GitHub, etc.)
• You must provide accurate and complete information when creating an account

Account Responsibilities

• You are responsible for maintaining the security of your account
• You must be at least 13 years old to use Pixaface
• You may not share your account with others
• You must notify us immediately of any unauthorized use of your account

To ensure fair access and maintain service quality, we enforce the following limits:

• Non-authenticated users: 2 image generations (stored in browser localStorage) with watermark
• Authenticated users: 5 image generations per day (resets daily at UTC midnight) with watermark
• Premium users: 50 image generations per day (resets daily at UTC midnight) * Can remove watermark *
• Image size: Maximum 10MB per upload
• File formats: PNG, JPG, JPEG, WEBP supported

We reserve the right to modify these limits at any time. Abuse of the service or attempts to circumvent these limits may result in account suspension or termination.

Your Content

• You retain all ownership rights to images you upload
• You grant Pixaface a license to process, store, and display your images to provide the service
• You represent that you have the right to upload and transform the images you submit
• You are responsible for ensuring your images do not violate any third-party rights

Generated Content

• You own the AI-generated images created from your uploads
• Generated images are stored in your account history for your access
• You may download, share, or use generated images as you see fit
• We do not claim ownership of your generated images

You agree NOT to use Pixaface for:

• Creating deepfakes or misleading content intended to deceive
• Uploading images of individuals without their consent
• Generating illegal, harmful, or offensive content
• Harassing, threatening, or impersonating others
• Violating any applicable laws or regulations
• Infringing on intellectual property rights of others
• Uploading malicious code, viruses, or harmful files
• Attempting to circumvent usage limits or security measures
• Scraping, crawling, or automated access without permission
• Any commercial use without explicit authorization

Violation of these prohibitions may result in immediate account termination and legal action.

The Pixaface service, including its software, design, logos, and branding, is owned by Pixaface™ and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our software or service
• Reverse engineer or attempt to extract source code
• Use our trademarks, logos, or branding without permission
• Create derivative works based on our service

PIXAFACE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Accuracy, quality, or suitability of AI-generated images
• Uninterrupted or error-free service operation
• Security of data transmission or storage
• Fitness for a particular purpose

AI-generated results may vary in quality and accuracy. We do not guarantee specific outcomes or that generated images will meet your expectations.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXAFACE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of data, profits, or business opportunities
• Damages arising from use or inability to use the service
• Third-party content, actions, or services
• Unauthorized access to or alteration of your data

Our total liability to you for any claims shall not exceed the amount you paid us in the past twelve months, or $100, whichever is greater.

We reserve the right to:

• Modify, suspend, or discontinue any part of the service at any time
• Change features, functionality, or usage limits
• Update these Terms of Use with or without notice
• Terminate or suspend accounts for violation of these Terms
• Remove content that violates these Terms or applicable laws

We will make reasonable efforts to notify users of significant changes, but continued use of the service after changes constitutes acceptance of the modified Terms.

Your Rights

You may terminate your account at any time by contacting us. Upon termination, your account data will be deleted within 30 days.

Our Rights

We may terminate or suspend your account if:

• You violate these Terms of Use
• You engage in prohibited activities
• Your account remains inactive for an extended period
• We are required to do so by law
• Continuing to provide service creates risk or liability

You agree to indemnify, defend, and hold harmless Pixaface and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Content you upload or generate using the service

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of Pixaface shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court to prevent infringement of intellectual property rights.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
